EQ3 Ltd. understands the importance of protecting the security and privacy of any personal information you provide. Your trust is important to us and therefore we have created a Privacy Policy that guides our practices concerning the collection, use, retention and disclosure of personal information of our customers, employees, distributors and suppliers.
1. WHAT IS PERSONAL INFORMATION?
Personal information is any information about an identifiable individual. This includes information such as a person's name, address, home phone number and email address. Non-personal information does not identify you as an individual. For example, EQ3 may ask you for your postal code to assist in planning what areas to distribute a sales flyer. EQ3 also collects certain non-personal information from EQ3 website users such as the Internet Protocol (IP) address of your computer and your Internet Service Provider, the date and time you visited the website, and the website pages you read and any content you downloaded from the website. This non-personal information is used by the website and system administrators to provide you with the best possible service.
2. DO I HAVE TO GIVE EQ3 MY PERSONAL INFORMATION?
No, the choice to provide personal information is yours. However, for EQ3 to provide its products and services to you, there are certain purposes for which your personal information is required. These include primary operational and/or administrative purposes, such as processing payment information, initiating product warranties, delivering your purchase to your home, and other operational purposes that are essential for EQ3 to provide products and/or services you request from EQ3.
By signing up for an EQ3 Insider newsletter, your personal information will also be used for secondary marketing purposes, such as providing updates on EQ3 products, sales, exclusive offers and special events, and asking for your feedback through surveys and questionnaires. Whether you want to share your personal information with EQ3 for these secondary purposes is entirely your choice. 3. WHAT ABOUT MY CONSENT?
Consent is your voluntary agreement with the way in which EQ3 collects, uses and discloses your personal information. Consent can be either implied or expressed. Implied consent is inferred from an individual's action or inaction. For example your consent is implied if EQ3 asks you to provide personal information for a stated purpose, such as those primary purposes mentioned in Question 2. Expressed consent is unequivocal, given orally, electronically or in writing by the individual, and requires no inference on the part of EQ3. For example your consent is expressed when you choose to "opt in" to having your information used for promotional purposes.
4. DOES EQ3 USE COOKIES TO COLLECT NON-IDENTIFYING INFORMATION?
EQ3 uses both session cookies (which are automatically deleted from your computer when you close your browser session) and persistent cookies (which remain on your computer between sessions) in order to facilitate your ability to use the website efficiently and effectively. By using our website while your browser is set to accept cookies, we imply your consent to them. If you are browsing or shopping online, we and/or our trusted third party agents track your movement through our website and collect statistics about your navigation, such as page views and time spent on the website, using click stream data and tag software. This information about your visit to our website is then aggregated with the information about other individuals’ visits. Using this non-identifying information, we strive to continually improve and enhance the online experience of all of our customers, to evaluate the success of marketing campaigns and to report on aggregated site usage. In no case is click stream data or tag software used by us to collect or store personally identifiable information.
5. DOES EQ3 SHARE A CUSTOMER'S PERSONAL INFORMATION WITH OTHER COMPANIES?
We disclose your personal information to our partners in order to provide you with our products and services. This, for example occurs when you choose to purchase a Zucora Extended Warranty and/or to facilitate a home delivery. Whenever we hire other organizations to provide support services, we will require them to conform to our privacy standards and to allow us to audit them for compliance. EQ3 respects that you may not wish to have your personal information shared in this way. If you do not want EQ3 to provide your information to others, please contact us in writing through the Contact EQ3 form by selecting Other under Type of Inquiry and your name will be removed from all shared lists. Please note that it may take from six to eight weeks to process your request.
6. MAY I REVIEW THE PERSONAL INFORMATION EQ3 HAS ABOUT ME?
Yes. Subject to certain exceptions prescribed by law and provided we can authenticate your identity, you can review the personal information EQ3 has about you by sending a written request to the Customer Care Manager. The Customer Care Manager will respond to your request within 7 days from the date your request is received. To authenticate your identity, we will need you to provide a utility bill or an identification document with your name/address and a photo id.
7. CAN I UPDATE THE PERSONAL INFORMATION EQ3 HAS ABOUT ME?
Yes, you can update the personal information EQ3 has about you by updating your online profile, by visiting one of EQ3’s retail locations, and/or calling the EQ3 Customer Care line at 4102.889.888.1.
8. HOW DOES EQ3 SAFEGUARD MY PERSONAL INFORMATION?
The security of your personal information is very important to us. EQ3 takes all reasonable steps to protect personal information against loss or theft, as well as against unauthorized access, disclosure, copying, use or modification. We offer continuous training to our employees stressing the importance of maintaining the highest standards of ethics and confidentiality.
9. HOW DOES EQ3 RECEIVE, STORE AND RETAIN MY PERSONAL INFORMATION?
All personal information provided to EQ3 in written form is secured in locked facilities with access limited to those employees who require it to complete their duties. If you are transmitting information to us electronically, all of your personal information is encrypted (or coded) through Secure Sockets Layer (SSL) protocol, and is only decoded when it reaches our servers.
10. HOW LONG DOES EQ3 KEEP MY PERSONAL INFORMATION?
EQ3 keeps your personal information for as long as it is necessary for EQ3 to provide you with EQ3 products and services. Personal information about a customer that is no longer required by EQ3 to fulfill the purposes for which it was collected, is shredded and disposed of in a manner that safeguards its confidentiality.
11. WILL THE EQ3 PRIVACY POLICY CHANGE?
The policy may change over time to accommodate changes in service, technology or legal requirements. EQ3 will add, change, or remove portions of this policy when appropriate. If there are changes or additions to this Privacy Policy, EQ3 will post those changes on the EQ3.com website. Customers will always know what information EQ3 collects online or offline, how it is used and what options are available to the customer. If EQ3 were to change its information practices or this Privacy Policy in such a way that your personal information may be used or shared in a different manner, EQ3 will give you the opportunity to opt-out of having your information used or shared in the new manner.
12. WHAT HAPPENS IN THE EVENT OF INSOLVENCY OR SALE OF THE COMPANY?
In the unlikely event that EQ3 becomes insolvent and seeks protection under applicable bankruptcy laws, EQ3 may share your personal and non-personal information with a third party that purchases the URL "http://www.EQ3.com" or assets of EQ3 relating to the website, who intends to continue to run or operate the website subject to this privacy policy, as it may be amended from time to time.
13. WHAT ABOUT LINKS TO THIRD PARTY WEBSITES?
This privacy statement applies solely to personal information collected by the EQ3.com website. EQ3.com may contain links to other websites. EQ3 is not responsible for the privacy practices or the content of such websites. EQ3 encourages everyone, when they leave our website, to read the privacy statements of each and every new website in regards to how they collect personal information.
14. WHEN ELSE MIGHT EQ3 DISCLOSE MY PERSONAL INFORMATION?

Request Verification
Before we can respond to a Request to Know or Request to Delete, we will need to verify that you are the consumer who is the subject of the CCPA request. Verification is important for preventing fraudulent requests and identity theft. Requests to Opt-Out do not require verification.
Typically, identity verification will require you to confirm certain information about yourself based on information we have already collected. For example, we will ask you to verify that you have access to the email address we have on file for you. If we cannot verify your identity based on our records, we cannot fulfill your CCPA request. If you submit a request not through our webform, we will ask you to provide the same information requested in the webform.
For a request that seeks specific personal information, we ask that you sign a declaration stating that you are the consumer whose personal information is the subject of the request, as required by the CCPA.
In some cases, we may have no reasonable method by which we can verify a consumer's identity. For example:
- If a consumer submits a request but we have not collected any personal information about that consumer, we cannot verify the request.
- If the only data we have collected about a consumer is gathered through website cookies (i.e. the consumer visited our website but had no other interaction with us), we are unable to reasonably associate a requester with any data collected; therefore, we cannot verify the request.
Authorized Agent
A California resident's authorized agent may submit a rights request under the CCPA by emailing us at ac.3qe@ycavirp. Requests submitted by an authorized agent will still require verification of the consumer who is the subject of the request in accordance with the process described above. We will also ask for proof that the consumer who is the subject of the request authorized an agent to submit a privacy request on their behalf by either verifying their own identity with us directly or directly confirming with us that they provided the authorized agent permission to submit the request. An authorized agent that has power of attorney pursuant to California Probate Code section 4121 to 4130 may also submit proof of statutory power of attorney, which does not require separate consumer verification.

Connecticut Privacy Notice (CTDPA)
This section provides additional information for Connecticut residents under the Connecticut Data Privacy Act (CTDPA). The terms used in this section have the same meaning as in the CTDPA. This section does not apply to information that is not considered "personal data," such as deidentified or publicly available information as defined in the CTDPA.

Collection and Disclosure of Personal Information

Data “Selling” and Targeted Advertising
We "sell" personal data to third parties, as that term is defined in the CTDPA.
We process personal data for purposes of targeted advertising (as defined in the CTDPA), including online identifiers and internet activity. This allows us to show you ads that are more relevant to you.

Profiling
The CTDPA gives consumers the right to opt out of automated profiling that produces legal or similarly significant effects, such as approval for a loan, employment, or insurance.
We do not profile consumers in furtherance of decisions that produce legal or similarly significant effects.

Right to Access
You have the right to confirm whether we are processing personal data about you and to access such data. Where processing is carried out by automated means, you have a right to receive a copy of your personal data in a portable and readily usable format that allows you to transmit your data to another controller.
If you make a Request to Know more than twice in a 12-month period, we may require you to pay a small fee for this service.
Right to Delete
You have the right to request that we delete any personal data provided by or obtained about you. We will permanently delete any such personal data from our records and direct our processors to do the same. However, we may retain your personal data if it is necessary for certain purposes, including the following:
- To comply with legal obligations
- To comply with an official investigation or cooperate with law-enforcement agencies
- To establish or defend legal claims
- To complete an obligation to you that you have requested
- To respond to security incidents, fraud, harassment, and other similar activity
- To identify and repair technical errors
- To conduct internal research to develop, improve, and repair our products and services
- For internal operations that are reasonably aligned with your expectations
Any personal data retained for these purposes will not be processed for other purposes.
Right to Non-Discrimination
If you exercise your CTDPA consumer rights:
- We will not deny goods or services to you
- We will not charge you different prices or rates for goods or services
- We will not provide a different level or quality of goods or services to you
However, we may offer a different price, rate, level, quality, or selection of products or services if your personal data is required in order to provide those products or services and you have exercised your right to opt out, or the offer is related to a voluntary loyalty or rewards program.
Right to Opt-Out
You have the right to opt-out of any selling of your personal data, processing of your personal data for purposes of targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects for you.
You may exercise your right to opt-out.Authorized Agents. You may authorize an agent to submit a Request to Opt-Out on your behalf, including through a technology such as a web link, browser setting, or global device setting. We will comply with such requests if we are able to authenticate your identity and the agent’s authority to act on your behalf.
Right to Correct
You have the right to correct inaccuracies in your personal data, taking into account the nature of the data and our purposes for processing it.
Authenticating Your Request
Once we receive your request, we will verify the information you provided by matching the information that we have collected. If we cannot authenticate your request, we may ask for additional information from you. If you are unable to provide additional information, or we are unable to authenticate the request using commercially reasonable efforts, we may deny your request. Authentication is not required for a Request to Opt-Out, but we may deny the request if we have a good faith, reasonable, and documented belief that the request is fraudulent.
Right to Appeal
If we decline to take action in response to any of your privacy requests, you have the right to appeal that decision within a reasonable amount of time, but no later than 90 days from the date of our decision. Notice of Financial Incentive
Users who sign up for our marketing emails receive a 10% discount on their next purchase. A consumer provides their email address and consents to receive emails in exchange for a discount provided via coupon code. To opt in, a user must enter their email address into the form and submit it. Auser may unsubscribe from our marketing emails by using the unsubscribe link in the email footer at any time. We calculate the value of the offer and financial incentive by using the expense related to the offer.
